Terms & Conditions
The terms and conditions stated below underline the protocol followed by the client when they have chosen to hire a part of BMS Entertainment’s services.
RESERVATIONS
A reservation is only made by verbal communication or e-mail. Once a request to make a reservation is submitted BMS Entertainment will contact you either by phone or e-mail to send the appropriate paperwork in order to finalize and confirm your reservation.
EVENT DETAIL FORM
The event detail form will be e-mailed to the client. Once received, it is important that you complete and submit the form as soon as possible. In order to ensure BMS Entertainment has the pertinent details of your event the form must be completed in its entirety. Once received by BMS Entertainment along with your deposit your date will be confirmed.
Please note if your event detail form is not filled in and returned along with your deposit within two weeks of the sent date BMS Entertainment reserves the right to book another function on your date without warning.
It is the client’s responsibility to make sure they have received the event detail form via e-mail. If the event detail form has not been received please contact BMS Entertainment and a new form will be issued.
CONTRACTS
Please read your contract carefully as important information about your event will be needed including dates, location, start and finish times, cost and additional costs. Please fill out your contract properly, making sure all areas are filled in and it is signed. If it is not signed it will be invalid and your date will not be confirmed.
ADDITIONAL HOURS
The client may request additional hours on the night of the function. Any additional hours will be charged at the companies overtime rate. Your DJ, venue, hall or event planner must grant permission. The DJ must have confirmation by venue, hall or organizer verbally and payments are to be made upon request.
PAYMENT METHODS
Cash payments and personal checks are accepted methods of payment. Clients may also pay directly by credit card via Visa, MasterCard, American Express or Discover. A security deposit is required in order to reserve your date. Please note unless there is an extreme circumstance all deposits are non-refundable.
PURCHASE ORDERS
If your company or organization operates on a purchase order basis a physical copy must be received prior to your event date including the following information:
1. A valid P.O. with: P.O. number, itemized order, correct total (including delivery & set-up fees if applicable), approval signature, correct billing and shipping information, and contact phone number must be supplied. This can be e-mailed to info@bmsent.com or faxed to (201) 660-7842.
2. Valid contact information including: phone number of the purchaser as well as an e-mail address of the person responsible for paying invoices.
3. Our terms are Net 30. The term must be specified in writing, on your purchase order.
4. If payment is not received within the P.O. term (Net 30 or other), interest charges will incur. Payments not received by the due date will be considered past due. If any payment is not paid when due a late charge shall accrue equal to 7% (or the maximum legal rate, if less) of the unpaid balance per month.
SALES TAX
All sales within the state of New Jersey are subject to sales tax. If you are a tax-exempt organization such as a non-profit, church or school system, and prefer not to be charged sales tax, a copy of your tax-exempt certificate (Form ST-4) is required before the date of your function.
EQUIPMENT
BMS Entertainment will select the equipment and lighting appropriate for the event depending on number of guests and the size of the venue.
It is the client’s responsibility that the area and surface of where the equipment is setup is satisfactory. For example: BMS Entertainment will not setup on gravel, sand, soil or grass. The equipment and cables must be covered at all times from direct sunlight or rain. If setup area does not meet the aforementioned requirements; BMS Entertainment reserves the right to refuse service.
EQUIPMENT FAILURE
BMS Entertainment thoroughly inspects and tests all equipment before and after each event to ensure a successful outcome free of unforeseen issues. Any and all problems with equipment must be reported immediately to BMS Entertainment to be considered for adjustment.
BMS Entertainment takes preventive measures to avoid any possibility of failure. Nevertheless when dealing with electronic equipment certain occurrences can arise when a system malfunctions. Our technical support staff is either on site or on call, and available to assist our clients with any complications that may transpire.
SETUP TIME
Clients must advise the venue that the DJ or Photo Booth Attendant will need access to begin setup at least 60 minutes prior to the commencement of the event. Approximately 60-minute setup time and 45-minute breakdown time is required. This is subject to change depending on venue circumstances such as stairs, location, parking and walking distance.
Discounts will not be granted if access is not available to the DJ or Photo Booth Attendant and setup time is delayed. The client will still be responsible to pay the full amount.
MISBEHAVIOR
The client is responsible for the behavior of themselves and their guests, invited or not. BMS Entertainment will not tolerate any misbehavior including different forms of intoxication.
If any physical, verbal or intimidating actions occur the DJ or Photo Booth Attendant will cease operations until the matter has been resolved. The client must resolve any issues within 15 minutes ejecting any persons from the event if needed. If there is no resolution within 15 minutes the DJ or Photo Booth Attendant will end the evening, breakdown equipment and leave the premises.
No refunds will be given and payment in full is still required. Our DJ’s and Photo Booth Attendants have the right to work in a safe environment and deserve to be paid for their time.
DAMAGE, THEFT AND INJURY
The client will take full responsibility for any damage or theft that may occur to equipment or personal property owned by the DJ or Photo Booth Attendant.
BMS Entertainment will not be held liable for any injuries that occur due to actions from the client or their guests especially from intoxication of any form.
